Limited Warranty

WARRANTY

Dowell Enterprises, LLC, dba DeluxGear, warrants DeluxGear products to be free from defects in material and workmanship for a period of 1 (one) year from the original date of purchase.  If you discover a defect in a product covered by this warranty, return it with your receipt to your point of purchase for a replacement. DeluxGear will repair at our option using new or refurbished components, or if repair is not possible, DeluxGear will replace the item.

This warranty does not cover damage due to user negligence, accidental damage, or tampering with the product. On the PinPoint, breaking the product housing seal, removing or breaking the warning label, tampering with sealed screws, or any unauthorized attempt to modify or repair the PinPoint except by a DeluxGear technician voids the warranty.

EXCLUSIONS

This warranty covers defects in manufacturing discovered while using the product as recommended by the manufacturer.  The warranty does not cover loss or theft, nor does coverage extend to damage caused by misuse, abuse, accidental damage, unauthorized modification, improper storage conditions, or natural disasters.

LIMITS OF LIABILITY

Should the product fail, your sole recourse shall be repair or replacement, as described in the preceding paragraphs.  DeluxGear shall not be held liable to you or any other party for any damages that result from the failure of this product.  Damages excluded include, but are not limited to, the following:  lost profits, lost savings, lost data, damage to other equipment, and incidental or consequential damages from the use of, or inability to use, this product.  In no event will DeluxGear be liable for more than the amount of your purchase price, not to exceed the current list price of the product, and excluding tax, shipping, and handling charges. In no event shall Dowell Enterprises, LLC (dba DeluxGear, LLC) or any of its subsidiaries or affiliates be liable for any indirect, special, incidental or consequential injury to persons or damage to property caused by the use of any DeluxGear products. Liability for a defective DeluxGear product covered by the Warranty above is limited to refund of its purchase price, repair, or replacement with the same or a similar product, choice of remedy to be made by DeluxGear; in no event will DeluxGear be otherwise liable for any damages due to non- or mis-performance by a DeluxGear product.

MODIFICATIONS: Any modifications to the PinPoint, including the removal of any labels, will void both the warranty and the certification made by the manufacturer of compliance with the FDA Federal Laser Product regulations.

By purchasing a PinPoint from DeluxGear, LLC, you hereby indicate that you understand and agree to the following: I will not use the laser in violation of any local, state, provincial, district, federal or other national laws, and I understand that it is my responsibility to know and abide by those laws relating to the ownership and use of lasers in my jurisdiction. I will not direct the PinPoint device at any public officials or utilize the PinPoint at public events without prior acknowledgment and permission. Under no circumstances will the PinPoint be directed at moving or occupied vehicles including aircraft. The PinPoint is not a toy and should not be operated or possessed by a juvenile.

DeluxGear disclaims any other warranties, express or implied.  By installing or using the product, the user accepts all terms described herein.

REQUIREMENTS

DeluxGear reserves the right to require the user to ship the defective product to DeluxGear in order to process a warranty claim.  The cost of shipping the defective product, including customs fees or duties, are the responsibility of the user. In the case of purchases from an authorized DeluxGear reseller, the warranty must be processed through that reseller.
